Every person solemnizing a marriage who fails or neglects to make and deliver an originally signed certificate thereof, within the time specified in NRS 122.130, to: 1. If the board of county commissioners has adopted an ordinance pursuant to NRS 246.100, the county clerk; or 2. If the board of county commissioners has not adopted an ordinance pursuant to NRS 246.100, the county recorder, is guilty of a misdemeanor.
